Justifiable Use of Force and You

Recently here in Iowa, in the town where I work and spend a heck of a lot of time, a man has been charged with assault and going armed with intent after chasing a trespasser off his property, had that been all there was to it, no problem. But the homeowner before chasing off the trespasser retrieved a handgun from his home and confronted the trespasser. The trespasser fled and the homeowner gave chase, left his property and then fired a warning shot at the trespasser after he had failed to adhere to commands to stop.

Here's where things get nasty.

In Iowa, you are allowed to use reasonable force to protect property, reasonable force includes deadly force. However the following bits of Iowa code apply.

704.1 Reasonable force.
“Reasonable force” is that force and no more which a reasonable person, in like circumstances, would judge to be necessary to prevent an injury or loss and can include deadly force if it is reasonable to believe that such force is necessary to avoid injury or risk to one’s life or safety or the life or safety of another, or it is reasonable to believe that such force is necessary to resist a like force or threat. Reasonable force, including deadly force, may be used even if an alternative course of action is available if the alternative entails a risk to life or safety, or the life or safety of a third party, or requires one to abandon or retreat from one’s dwelling or place of business or employment.
[C51, §2773; R60, §4442; C73, §4112; C97, §5102; C24, 27, 31, 35, 39, §12921; C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, §691.1; C79, 81, §704.1; 81 Acts, ch 204, §2]
“Dwelling” defined, see §702.10

704.2 Deadly force.
The term “deadly force” means any of the following:
1. Force used for the purpose of causing serious injury.
2. Force which the actor knows or reasonably should know will create a strong probability that serious injury will result.
3. The discharge of a firearm, other than a firearm loaded with less lethal munitions and discharged by a peace officer, corrections officer, or corrections official in the line of duty, in the direction of some person with the knowledge of the person’s presence there, even though no intent to inflict serious physical injury can be shown.
4. The discharge of a firearm, other than a firearm loaded with less lethal munitions and discharged by a peace officer, corrections officer, or corrections official in the line of duty, at a vehicle in which a person is known to be.
As used in this section, “less lethal munitions” means projectiles which are designed to stun, temporarily incapacitate, or cause temporary discomfort to a person without penetrating the person’s body.

704.4 Defense of property.
A person is justified in the use of reasonable force to prevent or terminate criminal interference with the person’s possession or other right in property. Nothing in this section authorizes the use of any spring gun or trap which is left unattended and unsupervised and which is placed for the purpose of preventing or terminating criminal interference with the possession of or other right in property.

704.7 Resisting forcible felony.
A person who knows that a forcible felony is being perpetrated is justified in using, against the perpetrator, reasonable force to prevent the completion of that felony.

702.11 Forcible felony.
1. A “forcible felony” is any felonious child endangerment, assault, murder, sexual abuse, kidnapping, robbery, arson in the first degree, or burglary in the first degree.
2. Notwithstanding subsection 1, the following offenses are not forcible felonies:
a. Willful injury in violation of section 708.4, subsection 2.
b. Sexual abuse in the third degree committed between spouses.
c. Sexual abuse in violation of section 709.4, subsection 2, paragraph “c”, subparagraph (4).
d. Sexual exploitation by a counselor, therapist, or school employee in violation of section 709.15.
e. Child endangerment subject to penalty under section 726.6, subsection 6.
f. Assault in violation of section 708.2, subsection 4.

713.3 Burglary in the first degree.
1. A person commits burglary in the first degree if, while perpetrating a burglary in or upon an occupied structure in which one or more persons are present, any of the following circumstances apply:
a. The person has possession of an explosive or incendiary device or material.
b. The person has possession of a dangerous weapon.
c. The person intentionally or recklessly inflicts bodily injury on any person.
d. The person performs or participates in a sex act with any person which would constitute sexual abuse under section 709.1.
2. Burglary in the first degree is a class “B” felony.
3. For purposes of determining whether the person should register as a sex offender pursuant to the provisions of chapter 692A for violations of subsection 1, paragraphs “a”, “b”, or “c”, the fact finder shall make a determination as provided in section 692A.126.

724.30 Reckless use of a firearm.
A person who intentionally discharges a firearm in a reckless manner commits the following:
1. A class “C” felony if a serious injury occurs.
2. A class “D” felony if a bodily injury which is not a serious injury occurs.
3. An aggravated misdemeanor if property damage occurs without a serious injury or bodily injury occurring.
4. A simple misdemeanor if no injury to a person or damage to property occurs.

702.16 Reckless.
A person is “reckless” or acts recklessly when the person willfully or wantonly disregards the safety of persons or property.

708.1 Assault defined.
An assault as defined in this section is a general intent crime. A person commits an assault when, without justification, the person does any of the following:
1. Any act which is intended to cause pain or injury to, or which is intended to result in physical contact which will be insulting or offensive to another, coupled with the apparent ability to execute the act.
2. Any act which is intended to place another in fear of immediate physical contact which will be painful, injurious, insulting, or offensive, coupled with the apparent ability to execute the act.
3. Intentionally points any firearm toward another, or displays in a threatening manner any dangerous weapon toward another.
Provided, that where the person doing any of the above enumerated acts, and such other person, are voluntary participants in a sport, social or other activity, not in itself criminal, and such act is a reasonably foreseeable incident of such sport or activity, and does not create an unreasonable risk of serious injury or breach of the peace, the act shall not be an assault.
Provided, that where the person doing any of the above enumerated acts is employed by a school district or accredited nonpublic school, or is an area education agency staff member who provides services to a school or school district, and intervenes in a fight or physical struggle, or other disruptive situation, that takes place in the presence of the employee or staff member performing employment duties in a school building, on school grounds, or at an official school function regardless of the location, the act shall not be an assault, whether the fight or physical struggle or other disruptive situation is between students or other individuals, if the degree and the force of the intervention is reasonably necessary to restore order and to protect the safety of those assembled.

708.8 Going armed with intent.
A person who goes armed with any dangerous weapon with the intent to use without justification such weapon against the person of another commits a class “D” felony.
To make a long story short, The guy saw someone trespassing, which is not 1st degree burglary, grabs a gun, goes out to confront him with a gun, the buy bolts, the home owner gives chase leaving his property, and then fires a warning shot into the ground when someone almost 7 yards away "takes an athletic stance"

At no point was he A: Defending property. B. Defending himself or another. C. Acting to prevent a forcible felony.

The trespasser at no time demonstrated ability, or opportunity to put the home owner in jeopardy from a reasonable person's perspective of the situation. Going armed with intent will probably be dropped as he will probably plea down to the assault charge which if the article (which I think made a mistake as "aggravated assault" does not appear in the Iowa code) is correct in the chain of events.

I'll ask around and see what the deal is with this, I'm actually surprised I didn't hear about this sooner....

As to the intent of the trespasser, I doubt he was looking to pick flowers, but as someone who recently went looking for a lost pet in the neighborhood...stuff happens and sometimes truth is stranger than fiction.

We'll see how this one pans out but it doesn't look good for the homeowner.

CIDT Updates

May was a big month for us. I spent a weekend at TDI in Ohio taking their Pistol II and III classes, a full review is in progress, the following weekend was spent taking the NRA Basics of Personal Protection Outside of the Home Instructors Course, and the weekend after that I found myself in a NRA Training Counselor Workshop and pending approval, I will be appointed and NRA Training Counselor which means that in the future we will be offering instructor courses as well.

Melody is currently taking the NRA's Refuse to Be a Victim Instructors Course this week so look for those offerings as well.

It is my hope that we will be able to begin holding Basics of Personal Protection Outside of the Home near the tend of Summer / early Fall where cooler weather will make working from concealment a little more bearable.

Our Iowa Defensive Pistol Classes will be undergoing a little fine tuning to talk more on the fundamentals of defensive shooting, gear placement, and a more in depth portion on holstering/re-holstering.

"School" is Never Out

During the course of the remodeling of our home, our son was playing with a paper target and one of the contractors found it, my wife and he got talking and she informed him that we are both instructors, they made a little small talk and the guy mentioned that he is a permit holder and that during his class there was shooting going on elsewhere and he could hardly hear the instructor during class. My wife informed him that we have an upcoming class if he'd like a refresher. His reply was "I have my permit, school's out"

This is the wrong attitude to have, "school" is never out, there is no one class that is the end all - be all of carry courses and while it may not be financially possible to attend every class there is, one should be open minded and cognizant that there is always room for improvement and more education on certain topics, going armed is one of them.

We should be perpetual students regarding the carrying and use of arms.

Be cool, stay in school.

Why We Require Students to Fire a Handgun in Our Classes.

On a discussion forum there's a topic regarding persons under 21 needing a permission letter to attend a training class despite being a legal adult at the age of 18, Iowa code requires persons between the ages of 14 to 21 to have parent or guardian permission to handle a handgun for training which is why we have such a letter ( the Instructor/Letter in question was not us/ours), someone chimed in that Iowa code does not require a student to fire or even handle a firearm. This is true, however different classes and instructors have different requirements and viewpoints on this matter. The NRA Basic Pistol Class has a firing portion and this is viewed by many to be the bare minimum in available classes. While we do offer our own curriculum that includes live fire instruction it is not to be unfair, it is not to justify cost, it is not for chest thumping over how many rounds we have students fire at our classes. It is to provide two things: improving the students ability to handle their firearm and show them what they can and can't do with their current skill set.

I recently attended training at the Tactical Defense Institute where I took their Pistol II & III classes. About half way though Pistol III you go through a Live Fire House (LFH) which contains a number of targets, apparently targets such as THIS are common throughout the LFHs. I was presented with this target and was able to place a shot just above the right eye socket of the "bad guy" holding my "wife" as a hostage. The student after me placed his first shot dead center into his "wife" and then placed a shot on the hostage taker. In one of the other LFHs, five out of eight students shot the hostage, two did not take a shot citing that they were not confident in their ability to take the shot.

I do not expect a newly armed person taking the classes that we offer to make this kind of shot under stress. I do not expect to create such a person in one day of training. The students at TDI last weekend had three days of top tier instruction and a good portion either shot the hostage or did not take a shot. There is nothing wrong with not being confident in taking such a shot if one knows that they do not possess the skill set  required to make that shot after just clearing a house and the added pressure of having an instructor and sometimes another student behind them watching their actions.

If one has never fired their gun before, what do they know about their skill set? What kind of faith do they have in their abilities? Have they even fired the gun they are now pointing at someone with their loved ones directly in harm's way?

When students leave our classes with a certificate of completion, we are enabling them to be armed should they meet a deadly force encounter. I don't like to quote movies, however "A man's got to know his limitations" If our students are not aware of their limitations they may make an ill fated decision in a time of stress. I want my students to know what they can or can not accomplish with a firearm.

It's not about being top shooter, it's not about bragging rights, it's not about a free hat to whoever has the best shot group, it's about instilling knowledge in one's abilities and producing a student that will be confident in his/her abilities to put shots on target or to know that they should not fire given certain circumstances.

A Whole New World...

For many years if you wanted your Iowa Permit to Carry Weapons you pretty much shot a bulls-eye style match shooting at 50' on a bulls-eye target (NRA B3) with a score of 65 (up to 85 pending on where you went). This was to obtain your permit to carry weapons on your person, to be used for defensive purposes...that never sat right with me. Most students who didn't know what they were walking into would come to class bringing the gun they intended to carry with them. Students bringing a pocket auto or j-frame revolver had very little chance of passing the course of fire with their carry guns and after flushing I don't know how many hours and dollars worth of rounds, they would then be handed a .22LR target gun to complete the course of fire. And the passed.

But what did that really accomplish?

Where can I get...

Along with questions about skill upkeep and carry related questions we get a lot of questions about where we get some of our supplies.

Most of our targets come from one of two places, either Pistoleer.com or National Target, locally there just aren't any good options and what you'll pay for targets at gun shops has always been ludicrous. I like the 50' reduced B24 silhouette targets for the in-door range at the Iowa River Gun Club along with the 50yard slow fire B-6(P) as they completely fill the target backer there. For out-door classes I really like the PistolTraining.com targets available from National Target. Of course there's always your standard IDPA and USPSA targets available form may sources, these are just some of what I have found that fit our needs rather well.

Ammunition has been the biggest issue over the last couple of years. In Iowa .45ACP and .380 are still pretty scarce and if you can't find any in your area there are three places I order ammunition from and I'm looking into a third. We've ordered a lot of "target" ammunition from Ammoman.com, Natchez Shooters Supply and occasionally Georgia Arms, for ammunition to be used for defense, I generally order from two places, Tactical Defense Soloutions and Ammunitiontogo. Between them you should be able to get a decent price on ammunition.

For your run of the mill firearms accessories, I like Brownells as they are local to Iowa and have one heck of a return policy. Generally if I order before lunch I can have my stuff next day, two days max. Midway USA is another good source for many products and they probably offer one of the best possible range bags available, the Midway Competition Range Bag. Brownells gets most of my business, I'm a fan of supporting local businesses and Brownells has always done me right. I particularly like if I'm in the area I can drop in and pay cash and get a discount.

That pretty much covers the non-local stuff. If you want to get your hands on gear in Iowa, it pretty much means a trip to Scheels, generally they're overpriced but there's a severe lacking of good gun shops in the state. Roberts Gun Shop gets good reviews, and there's a nice shop up in Fort Dodge, Kieth's Outdoors that has fair prices and a decent selection. Other than that your best bet to window shop is at a gun show, but I hate paying an entry fee to browse.

Keeping the Skills Sharp

Many students have asked how to go about staying sharp on the skills they learn in our classes. Fist and foremost dry practice is highly recommended. It's cheap, it utilizes gear that you all ready have and will will also help increase gun handling & familiarity. All you need are some spent casings or snap caps and you're ready to go. There are a couple different ways to go about dry fire practice, I tend to just hang a target on the wall of my basement. Dry practice is not for firing only, work your reload skills as well. I have some pads that I stand on to help preserve my mags as the basement floor is concrete, but it pays off. The thing to remember with dry practice is that there is to be NO AMMUNITION anywhere near where you are practicing, and once practice is over, stop handling the gun. The internet is full of stories regarding shot TVs and bedroom walls.

Next up is general range practice, pending on what's available you may be limited on what you can do at the range. Fixed firing points, rules prohibiting working from the holster etc. can put a damper on your improvement, but it's better than nothing. if you have a friend to go with you you should shoot in pairs as one can watch what you're doing and provide feedback.

My favorite means of skill maintenance is currently competing at the local level in IDPA and every once in a great while USPSA, I want to attend more of the USPSA shoots and get a better feel for it, but between being a home owner, husband, father, full time radio technician, part time instructor, etc I can't shoot nearly as much as I want to. I try to make one match a month, thankfully in central Iowa I'm close to plenty of clubs that cater to IDPA and USPSA.

Permit Renewal Shoots

Iowa code requires one renewing their Iowa permit to carry weapons to either take another class or "qualify" on the range with either a law enforcement or NRA instructor. If you are looking to renew your permit and want to perform a requalifiation shoot (usually takes less than an hour) you can email John Lauer  to schedule your renewal shoot. We shoot our renewals in Traer, IA and Marshalltown, IA.

The range in Marshalltown is just north of US 30 which would be be the better location for permit holders in the Ames, Grinnell and Newton areas. Permit holders residing in the Blackhawk Co. area, Trear would be preferred.

Your renewal training or requal shoot must have occurred within one year of your renewal date, and your renewal paperwork must be submitted 30 days prior to the expiration of your current permit.

Renewal shoots cost $25 for up to one hour of ranger time and consist of firing a minimum of thirty shots at distances of 5, 7, and 10 yards. Twenty-four of those thirty shots must  be inside of an 8" circle. If additional time is needed, there will be a $5 charge per half hour.

Future Training Oppurtunities

We are currently negotiating with the Izaak Walton League of Marshall County regarding the usage of their clubhouse and range for classes in the Marshalltown area. If things go as planned we will hopefully be able to start offering the NRA Basics of Personal Protection Outside of the Home (PPOH) in July.

Melody is enrolled in the NRA's Refuse to Be a Victim (RTBV) instructor course this June and we will be adding that to our curriculum as well. We will most likely be seeking another venue for the RTBV classes and my try to have the YMCA in Marshalltown host these classes for us.

We will not be holding any classes the month of May as we are attending training classes of our own as well as the NRA PPOH Instructor Course. I will be taking Pistol II and III at the Tactical Defense Institute of Ohio to meet the pre-requisites for their Team Tactics Course. Melody was going to attend these as well but as she will be into her second trimester with our second child that much shooting is not advised.

We hope that next Spring she will be able to attend the level II and III class so that we can take their Team Tactics Course and better develop a curriculum for a Couples Concealed Carry Course to be offered in 2012.

CIDT Iowa Defensive Pistol Class - April 30th - Traer, IA

This course is cousin to the Wolf Creek Carry Class offered last fall, it is an Iowa specific carry class detailing Iowa code and the fundamentals of carrying and using a pistol for self defense. An excellent course for those looking to further their knowledge base having taken other less informative classes or for those looking for information regarding the recent changes in Iowa law or those looking to renew their permit.

This class incorporates both lecture and range instruction. It is designed to educate the Iowa Permit to Carry holder on the mindset, equipment, tactics, law, and handgun safety associated with carrying a firearm every day for self defense. Learn where you can and cannot legally carry your firearm, the best means of carry, in what situations the use of a firearm may be justifiable and the best tactics involved in deploying your firearm in a self defense situation. Range portion will include working from the holster (if applicable), acquiring multiple targets and shooting at different distances.

This class is for those with a comfortable, working knowledge of their firearm. If you have never fired your firearm before or are not comfortable with its operation we strongly recommend taking the NRA Basic Pistol or Developing Pistol classes before enrolling for this class.

Under Construction.

Events and updates coming soon. For more information regarding our Iowa Permit to Carry Weapons classes see our website, Central Iowa Defensive Training.
